Motor car accident damage claim service, in South Africa

First of all we have to definite what we have to understand will be full and fair motor accident damage compensation. But even before doing so, we have to clarify that the South African System of motor car accident compensation, is split off into the sector of bodily injuries, which is dealt with very different to that of material damage compensation. The web pages you are browsing currently only focus on the material and civil claim for you to receive the full and fair traffic accident damage compensation occurred to your vehicle.

The South African law say: You should be materially compensated so that you will be able to have your damaged auto repaired to the state it was in, before the traffic collision impact. That means either you cannot expect a new car (some exemptions excluded here i.e. if your motor vehicle is very much new, so saying not older than a year since being on the road the first time) if your one is fairly used and the marks of wear and tear are visibly impacting you auto value.

But even an older motor car must be repaired to manufacturer's standards to maintain the roadworthy status of the then repaired vehicle.

So to say it in short, get it back on track, but do not try to make a fortune out of it, as that can easily backfire on you. But this does not mean you have to agree to too many compromises in terms of your motor car repairs. To have your damaged car back into the state it had been before, you need to prepare a solid base of value analysis for your compensation, either by a qualified repair quotation or by a professional damage assessment.

But nothing is always stringent and you cannot take one argument alone to find the correct compensation basis. There may even be differences in what you might have to accept as motor car accident repair compensation, in either a third party claim or a claim you direct to your own comprehensive motor insurance policy.

A claim launched with you motor insurance company will have to look on what you have covered under your policy and probably have some contributions to accept, due to the content of your policy.

A 3rd party claim, directed to the perpetrator however must give you full compensation and no clauses, as insurance excess or other limitations in your insurance policy apply.

In most cases, you should have some professional support. If you want to get the matter sorted out quickly, possibly with less costs as possible, and being compensated for your car accident damage fairly, you should consider and let a car accident damage claims specialist such as RAMLA, or your local attorney working for you.

Motor vehicle accident damage claims vs. insurance companies for your damage to be paid - in South Africa (RSA)

As a South African motor car driver in public traffic, you are currently not obliged to have motor insurance .

Only about 35% of vehicle drivers on public roads are insured against losses that may be burdened on to a motor car accident victim.

You may think, if the other party in a motor car crash has motor car accident insurance cover, for 3rd party material damage compensation, you are lucky?

Yes in a way you are, as if the motor insurance company of the liable party has finally agreed and the claim is approved, you will be paid, when a claim for motor accident damages. But firstly the claim has to be finally approved by the insurance company of the liable party and a settlement being concluded before any pay can be expected. But to come to an approval can take its time and lots of effort.

But is not always an easy task arriving at a mutual and satisfactory settlement in the case of car crash damages, with South African insurance companies.

Unfortunately, the insurance company will not simply pay what they are asked to pay. They do their own vehicle damage assessment and evaluation and have their own opinion on who may be liable, or who will be partly liable, etc.

When you need to claim for motor crash damages and the insurance will not offer a satisfying solution, you can only claim directly from the liable party, as person or entity, and you cannot direct your legal claim against any insurance companies, as they only indemnify their insured for repayment of the sum paid or spent on repair or replacement of any damaged vehicle

We would like you to comment on your experience with car accident claim against a party insured by a South African insurance company. Also, tell us if and how you received compensation.

Acknowledgement of Liability given or wanted from the other party deemed liable for car crash damages , in South Africa (RSA)

To motivate the other party in an auto accident (who seams clearly liable) to give you a signed statement in writing, right there on the scene of the traffic accident, will be a milestone for your claim.

Getting such an acknowledgement, documenting the rough details of the car crash and the damages occurred to your property, from the other party, will assist you in enforcing compensation sooner, and will help to avoid costly and time consuming court cases.

If you are in the process and in contact with the liable party, caused the auto crash damages, you should always try to get such acknowledgment of liability. There might be some forms out there in the web and even on the RAMLA web page in the download section, but each and every incident is different and to achieve the best for you RAMLA strongly recommends an individual drafted acknowledgement of liability, aiming for you to have a liquid claim including minimise the risk of opposing any summons, if despite your contractual acknowledgement the other party do not comply.

You can always contact RAMLA in that regard.

Do you know that most of the South African insurance companies do not allow their insured members to accept or acknowledge liability, not taking the risk having the motor insurance cover withdrawn?

For RAMLA this behaviour of South African motor insurance companies constitutes a breach of fairness and code of conduct, as it can only be designed allowing the insurance companies, to find a strategy to mitigate their payment obligations, by opposing or deny your claim.

Please find a prepared form for acceptance of liability to your disposal by following the link above, to download free of charge.

Please comment if you have had experiences with such prohibition and results, when South African insurance companies revoke the insured cover due to acceptance of motor accident liability. It will enable us to make such information, available to the broader public

Affidavit- to state declarations made under oath , in South Africa

An affidavit is a statement given under oath, a sworn declaration often used to affirm matters and support evidence, when cases are in dispute. You must formulate the circumstances in writing, stating your personal details and have such statement signed by a commissioner of oaths, to confirm that it is your statement and made to the best of your knowledge, and that you swear that it is true, personally signed in front of the officer, after a check of your ID.

Such affidavits support your evidence in court, enforcing damage compensation caused by car accidents. Make sure that all important statements are made in the form of an affidavit. In doing so, you will reduce the need for having witnesses in court to proof your motor accident damage claim, when no solution before court can be achieved.

But to RAMLA experiences a lot of such self-made affidavits lacking essential data and relevant information, but on the other hand stating irrelevant matters which have no significance in the effort to proof your claim.

It is always advisable to get the affidavit drawn by a knowledgeable person who knows what is important and what you do not need to swear on. RAMLA can help you here too.

An affidavit can be signed and stamped at a police station where a commissioner of oaths will be available, presently still free of charge

Apportionment of liability for the cause of a motor car accident, must be determined if the liability is not clearly derived from one party alone

Apportionment of liability must be determined for any car accidents, where it is not obviously clear and can be proven, that only one party was on fault for the cause of the vehicle crash. Apportionment of liability for auto accidents, will define the percentage to which liability must be split and to which party, meanings to define which party will be liable for the car accident, and to what extent. This determination will have a direct impact on your motor vehicle damage compensation.

Dealing with apportionment is a favourite tactic of many car accident claim defences and often used by South African insurance companies. The calculation some insurance companies rely on, is to arrive at a low figure for any settlement offer. It can be funny and tricky to understand the calculations, as all or lot of the total damage of all participants will add up, and then the parties will be liable for the percentage that was decided on of such proportion and based on the complete damage of all participants. That can work out expensive for a participant and must not automatically be correct and fair.

If you have had good or bad experiences in this sector of claim settlement, let us know about it.

Assessment - Vehicle damage assessment to determine motor car accident damages

When a car accident occurs, and motor car damage must be determined, a vehicle damage assessment will often be undertaken by either the insurance company (who have to indemnify their insured member), or by the party who needs to claim for vehicle accident damage compensation.

Either way, a professional vehicle damage assessment is more valuable than just a repair quotation from a specialist in motor damage car repair. When an insurer sends an assessor to assess the car damage, make sure that the vehicle damage assessment is correct. You can only do any research if the vehicle damage assessment is fair and acceptable, when you know about the content and have a copy.

It should be noted that an vehicle damage assessment ordered by an insurance company, is aimed at reducing the pro rata car accident damage compensation. An objective vehicle damage assessment can only be achieved, if all parties select and agree to a qualified person or institution to document and assess the car damage professional and independent.

RAMLA recommends that you always use an independent professional damage assessor, to prove your car accident damage case correctly, full and fair.

Please share your experiences in vehicle damage assessment matters with others. We will gladly publish more examples on the RAMLA web page.

Assessment Agreement - one should consider binding the vehicle damage assessor to supply a full copy of the report!

The insurance company or the person, most likely to be liable for your individual car accident, will often order a motor car damage assessment, with the aim of evaluating the damage liabilities, for auto damage compensation. The owner of the damaged car should at least have a full copy of the motor vehicle damage assessment report, done in the order of the liable party or the insurance company paying the damage on behalf of the insured.

To some extend it can be a challenge to receive a full copy of the motor vehicle damage assessment report, in a later stage. Some insurance companies are not very cooperative to get you having the full information you need to determine your position.

To have a written agreement, to receive a full copy of the vehicle damage assessment, with the assessor, who is in charge to do the motor vehicle damage assessment, to determine the damage for the liable party, before you physically allow doing the vehicle damage assessment, will help you very much.

You need to have a full copy of the vehicle assessment report, including the photographs taken to understand the findings and to crosscheck, if you can accept the conclusions as basis for your compensation.

Most commonly, this damage assessment will be the basis on which the insurance company will base its settlement. You are welcome to download the RAMLA assessment agreement form free of charge, by following the link above.

Assessors' Qualifications to be regarded as professional and fair, in South Africa (RSA)

If an assessor wants to be a professional car damage assessment expert, the assessor he must have the proper qualifications. Intimate knowledge of automotive repairs, detailed technical qualifications and the ability to work independently is essential.

Experience and meticulous work during the inspection and in preparing the report are major factors. A qualified assessment must be accomplice by qualified photographs, where the damage can be driven from. Sometime observed photographs taken on storage or scrap places, where the damaged vehicle is in a row and surrounded by other damaged vehicles, not giving space to take appropriate pictures of the vehicle damages, are not suitable.

Any qualified motor vehicle damage assessor will have access to specific data about manufacturers' repair specifications and parts, recommended labour costs and prices for original parts.

Damage repair must be calculated using the car manufacturer's agents' price list and based on original parts. A qualified vehicle assessor must have excellent training and a good track record.

One cannot be a qualified assessor when derived his qualifications by simply working in a garage or workshop or being a panel beater, even if for years.

We always welcome your comments.

Attorneys supporting or pursuing your motor car damage claim, in South Africa (RSA)

When facing a dispute in terms of any car accident crash or motor vehicle damages suffered in traffic accidents, there will and must always be a way to settle. A settlement can be before court or the specific case must be heard in court to find a solution and a judge/magistrate determines the liability and the damages to be compensated for in the verdict. The judge's decision is final and binding for all parties, unless an appeal to the next instance of courts, is filed.

Suffering car accident damage and one need to claim for compensation legally, there is no other way as to enforce it in court. To be able to follow the court rules, it will be highly advisable or even necessary to take advantage of an attorney or other knowledgeable institutions as road accident managers to pursue the case.

As to general experience not all attorneys works successfully, in respect to outcome and the client's expectations to win a case for car accident damage compensation. Unfortunately in most court cases only one obtains judgement in his favour, meaning the other one loose out. Achieving a judgment in your favour is the reason you mandate an attorney.

It must be mentioned that the success of Attorneys work is highly depended on what he finds to utilise as evidence and proof in the documentation of your motor vehicle accident. The best Attorney will by chance only be successful, if he have the full details provided by the client and makes sure proof and evidence will stand the opposite parties arguments.

It will be very helpful to know about your experiences with attorneys and courts dealing with your damage claim.

Attorney costs can be as high as your total compensation for your motor car damage claim, in worse case even higher, under South Africa (RSA) law and cost award schemes.

When you need an attorney to pursue your car accident claim, this will automatically entail cost's for the attorney's service. In South Africa, you may have to face the fact that the cost for the attorneys might be much higher than the amount you will be awarded provided that you are successful in your court claim, mostly due to the fact that the cost awarding schemes in court are totally insufficient to compensate a claimant, even winning a full case 100%.

It may be the case that the compensation that you are rewarded will not even cover the legal cost you have to pay. If the value of the claim is small, one must be very carefully evaluate the economic success of the claim. There are alternatives to use when claiming for motor car damage compensation, though. You can use a specialist, like RAMLA.

Your Attorney should be a specialist in vehicle accident damage claims for compensation, in South Africa (RSA)

Claims for your car accident compensation must be grounded in reasonable proof, and you need experienced support and advice in vehicle accident claim matters. Your lawyer should guide you through the entire claim, inform you of what to expect and what will be needed to claim properly.

Your lawyer should have handled such traffic accident claims - not really their favourite claims - and you should make sure that not just a candidate attorney does the work, in order to save on cost on the side of the law firm. A candidate attorney need training, but can be a risk for your claim if not guided very closely, which means at the end more work for the responsible attorney as if he/she will do it themselves.

Do you have some comments regarding your own damage claim?

Attorneys' Tariffs are the basics for the remuneration to be paid for the service, in South Africa (RSA)

As everybody knows, attorneys do not work for peanuts! They need to make a living. You can only negotiate remuneration before you hire an attorney in South Africa.

One option is to deal on an "attorney to client"-basis. This means that you have to pay your attorney fees mutually agreed upon. The attorney will charge you for all the actions he takes: initiating meetings, court procedures, researching, correspondence, etc. The fees may vary between R750 per hour for a junior attorney to R3 000 or more per hour for an experienced attorney.

With such a tariff, not all the activities your attorney billed to you will be rewarded by the sued party if you win the case. There will be a significant surcharge to be paid out of your own pocket.

Another option is to deal with attorney fees on a "party to party"-basis. This method is based on the attorney performing only absolutely necessary tasks (as listed in the court cost schemes), to pursue the claim.

An attorney who accepts such tariff might not be able to do and support all advisable tasks, as he will not be paid for it. Only the limited activities, allowed by the cost taxation, to pursue a claim for motor car accident damage, will be paid by the sued party after costs have been taxed, and only if the claim is decided 100% in your favour.

You can also negotiate "contingent fees". This means that you will only pay the attorney if you win the case. But if you win, you will have to pay a higher fee than normal to cover the risk and financing of the claim for the attorney.

Logically and realistically an attorney will only make such arrangement if he is quite sure that the case has a high potential to be won. This will motivate the attorney to give his best, and in return, he will enjoy the "big" piece of the cake. There might even be other motivations, such as public relations, if your motor car accident case is in a way spectacular or other remarkable persons are involved.

Please leave a comment about your own experience, to help others to choose the correct tariff.
